Terms of Service (Wholesale)
By purchasing any Kantha Bae Wholesale products, you are agreeing to all of the below terms.
BECOMING AN EXTENSION OF KANTHA BAE…
At Kantha Bae, we proudly partner with families in India and Bangladesh to create our beautiful, handmade apparel, accessories, and homewares you’ll find in our store. We know these souls by name and are active participants in their daily lives. We are all growing together to bring a different story to the retail world and give a platform and voice to those who have amazing gifts to share to the world. We are so grateful to have found these partners in Northern India and in Bangladesh that allow us to carry out the “why” of this business…. Making a difference in lives and helping others share their stories. By joining our Wholesale program, you are becoming an extension of Kantha Bae and we encourage you to share these stories with your customers. You can read more about the ‘Story Behind Your Kantha’ here, on our blog. In every order, you will receive our Story Cards that you may hand out with every Kantha Bae purchase in your shop!
RESELLERS PERMIT OR SALES TAX LICENSE
ALL Kantha Bae Wholesalers must have a Resellers Permit and/or a Sales Tax License in order to be approved for this program.
MINIMUM ORDER REQUIREMENTS
The minimum order requirement for accounts is $350 net (wholesale cost of goods ordered).
All products must be ordered in “minimum quantities” where listed. Please account for this when placing your order.
All orders not placed that violate these requirements will be held unshipped until the requirements are met.
GENERAL
Retailers are only authorized to sell at retail locations approved by Kantha Bae. Any new locations must be approved by Kantha Bae before the product can be sold.
All Market/Event Vendors must submit a link or flyer for each event they will be selling product at for approval from Kantha Bae before attending the event.
In-Home retailers, kiosk locations, Amazon Resellers, Facebook e-tailers and reselling groups, reselling Apps such as Depop, Poshmark, EBay, Etsy, ThredUp, 3rd party sellers, and consignment locations are not permitted.
Wholesalers may not sell Kantha Bae goods received at Wholesale prices in any Facebook Reselling and/or Trading groups.
Live Selling your Kantha Bae merchandise is permitted, as long as you call this sales channel out during your Entry Phone Interview with Jessica. Upon request, you may need to submit a calendar plan of Live Sales to us in advance.
Kantha Bae hangtags and labels may not be removed from products under any circumstances. Any rebranding of Kantha Bae goods is strictly prohibited. Kantha Bae brand and product names must be listed in all Online Listings. For more info on this, read on to “Product Customization”.
The retailer agrees that Kantha Bae retains the right, in Kantha Bae’s sole discretion, to terminate accounts, reject orders, and revoke access to Kantha Bae’s products and services at any time, with or without cause, without prior notice or explanation, and without liability to the retailer. The retailer retains the right to terminate the account but must pay Kantha Bae for all products shipped to the retailer.
Approval for the Kantha Bae Wholesale Program will come formally via email in 2-7 business days after applying. All retailers applying for the program must complete the application in full with as much detail as possible and complete a phone interview with the team. Kantha Bae reserves the right to deny any application that does not align with the brand.
PRICING
All prices listed on this website are in U.S. dollars. Prices may change at any time without notice. If we find that the price of any product is quoted incorrectly, we reserve the right to rectify such errors and omissions even if the order is already placed. We will inform the retailer about the correct price as soon as possible and give the option to cancel the order or proceed with the order at the rectified price.
Shipping is charged at a $35 flat rate fee for all Wholesale customers, and is waived at orders over $1500 net (wholesale cost of goods). See “Shipping” below.
Our Wholesale prices and price lists of product made available by Kantha Bae shall be deemed as Confidential Information and to be used by approved retailers only. Publishing or revealing any Confidential Information disclosed to retailers is strictly prohibited.
SALES AND DISCOUNTS
In the event the Retailer offers BRAND SPECIFIC discounts on any Kantha Bae products, the aggregate value of such discounts shall be limited to twenty percent (20%) of the MSRP, and any such promotional event shall not be longer than two (2) weeks. This does not include "whole store discounts", or "one-time-use discount codes", like Advertisement discounts or first-time customer codes for email or text subscriptions.
Permissions for special sale events beyond the 20% discount by the customer shall be requested in writing. Such requests shall not be unreasonably denied. Black Friday Sales do not need a written request.
Retail Price is at the retailer’s discretion as long as it is not listed below the suggested retail price provided by Kantha Bae. Refer to retail pricing on our website for Kantha Bae MSRP.
PRIVATE LABELING
As a retailer, you are part of the story sharing process - inviting your customers to become part of the bigger picture and ultimately changing the lives of families across the globe. When our clothes become part of your shop, the hang tags provided and the tags placed on the pieces are the ways the mission is carried forward. Thank you for understanding this important piece of our story sharing process and respecting the details.
Private Labeling is not currently offered or supported at this time by our partners.
PAYMENT TERMS
Kantha Bae accepts all major credit cards, including Visa, MasterCard, American Express, and Discover as payment for goods. We also accept ShopPay and AfterPay at checkout for those looking to split payments. We can not split payments on multiple cards under any circumstances. Full payment is required before the products will be shipped.
ESTIMATED LEAD TIME
When an order is placed, please allow 3-7 business days for the order to be shipped. It is very possible for your order to be completed in a shorter time frame. Please contact jessica@kanthabae.com if you need your items sooner.
We ship out of Old Hickory, TN using FedEx Ground.
ORDER CANCELLATIONS
Kantha Bae does not offer order cancellations at this time. Each product is designed and handmade and much time and effort is put into each order.
RETURNS
Returns are not accepted. In some cases trades will be considered at Kantha Bae’s discretion, and we hope to help you curate the best collection of Kantha Bae for your shop. Once an order is received by the retailer, the transaction is complete. If you feel you have received defective or damaged goods, please contact us and we will discuss arrangements at Kantha Bae’s discretion.
If your return is considered, please be advised you will be responsible for a 15% restocking fee, based on the total dollar value of the goods you are returning. The Retailer must cover all shipping costs for the return of saleable merchandise.
Please know that all of our Kantha and Silk apparel and accessories are made of 100% upcycled, vintage fabric. They have lived a full life before becoming the designs in our shop. Fabrics may have small threads or holes in the layers. Color inconsistency or small stains may be present. The saris are sewn together and extend the life of each design. Certain imperfections should be celebrated!
If you are not completely satisfied with your purchase from Kantha Bae, please contact jessica@kanthabae.com and we will do whatever we can to help resolve the issue.
In the event you receive merchandise you are simply not satisfied with, please contact jessica@kanthabae.com to discuss an exchange. Store Credit will be given in the form of a Code and must be used within 30 days of issue.
SHIPPING
Shipping is charged at a $35 flat rate fee for all Wholesale customers, and is waived at orders over $1500 net (wholesale cost of goods). We ship from our Warehouse in Old Hickory, TN and ship with FedEx Ground for all Wholesale orders.
Kantha Bae accepts no liability for any loss resulting from the customer’s failure to comply with our carrier’s delivery. If the carrier has to return the shipment to us, the customer will be liable for all shipping charges and credited for all merchandise returned in sellable condition.
At checkout, you will see the “KB PROTECT” toggle selected. This is our Kantha Bae shipping protection program that covers you in the event that a package is lost or stolen in transit. It is auto-applied at checkout so that it is not overlooked and resulting in any ineligibility for protection in the event it is needed.
Packages are considered lost/stolen when they have not been received by you and the tracking updates have not changed for 14 days (domestic) and 30 days (international). You have 5 days from the day they are considered eligible to report to file your claim with Kantha Bae. You can read more about the KB Protect terms here.
KB Protect is optional, and can be unselected at checkout if you wish to omit yourself from the service. By opting out of the service, Kantha Bae is not liable for any lost or stolen packages part of an order that did not include the KB Protect service. You must select KB Protect on ALL orders you wish to insure.
INTERNATIONAL ACCOUNTS
We are happy to accept International Wholesale accounts! We ship via FedEx for international orders. Please contact jessica@kanthabae.com with any questions. Kantha Bae is not responsible for any customs fees charged.
PRODUCT CUSTOMIZATION
The items available for Wholesale by Kantha Bae are listed on the line sheets provided and our Wholesale website. Customizations and special orders are not available at this time. We will do our best to accommodate color and pattern requests when made, but can not guarantee availability due to the one of a kind nature of our pieces. Please respect all details related to our products. All tags must stay intact.
When carrying Kantha Bae products and reselling them, Wholesalers are strictly prohibited from altering the products in any way, including adding or removing design details, removing colors or adding colors, labels, or stickers (other than a UPC sticker), etc.
Products may not be rebranded.
Hang tags and labels are required to be attached to all Kantha Bae products before and after purchase, and removal is strictly prohibited. Should we find these details are being altered or removed, our Wholesale partnership will be terminated.
ONLINE SELLING POLICY
Selling Kantha Bae directly from third-party online retailers or any online marketplaces (such as amazon.com, etsy.com, or ebay.com) is strictly prohibited. Retailers can apply to sell on their own Website as well as their brick and mortar permanent retail stores by filling out the account application for approval. All website links where Kantha Bae will be sold must be included on the application, as well as links to Social Media where “Buy” buttons are utilized, such as Instagram and Facebook.
Retail partners must list “Kantha Bae” in the title of the products sold on their own website and maintain our product names. Failure to do so will result in one warning, and termination of the partnership if still not compliant after the warning.
Failure to provide full visibility and comply with the terms to report the use of all sales channels are grounds for termination of the partnership.
Kantha Bae Facebook reselling pages (“BST Groups”) are not affiliated with Kantha Bae and you may not sell Kantha Bae items received at Wholesale prices on any Facebook reselling/trading groups. Failure to comply with this request will result in one warning, and termination of the partnership if still not compliant after the warning.
WARRANTY
By placing an order, the retailer agrees that Kantha Bae makes no warranty, whether expressed or implied, regarding the merchantability of any product line made available on the website. The retailer also agrees that Kantha Bae shall not be liable for any misrepresentation or misuse of its products by the retailer, its customers or the end users, and indemnify Kantha Bae from actions or proceedings that may emanate from such misrepresentation or misuse.
COPYRIGHTS AND BRAND ASSETS/INTELLECTUAL PROPERTY
Kantha Bae products hold the Kantha Bae trademark which may not be infringed upon. All photos are property of Kantha Bae, and Wholesalers are permitted to use for selling of Kantha Bae products only. This includes only the photos created by Kantha Bae, and DOES NOT include our Community Generated Imagery submitted by our customers.
Any photos used of Kantha Bae products taken from social media must credit the original creator of the content.
All Kantha Bae product photos and photoshoots must remain unaltered, aside from simple and light color filtering. Wholesalers may not otherwise alter, photoshop, or reuse photos in any way.
Kantha Bae may provide product images and other brand assets as requested for business promotion. Please acknowledge that all promotional and marketing materials, including but not limited to blog articles, illustrations, images, and audio-video media are fully protected by copyrights, and owned and controlled by Kantha Bae.
Kantha Bae grants to customers a limited license to use and display the logo and other intellectual property provided by us. Use of any mark or image requires prior written consent from Kantha Bae.
